Contested Divorce Attorney in St. Petersburg, Florida

The path of marital dissolution is never easy, but when agreements cannot be reached, a contested divorce becomes inevitable. While the ideal scenario would involve both parties agreeing on the terms of divorce, it's much more common for dissolving partnerships to involve disagreements and disputes.

Dealing with any divorce or family law issue in Florida can be overwhelming. If you find yourself approaching a contested divorce, it's essential to understand the challenges ahead and how an experienced law firm can support you through this tumultuous time.

You're likely filled with "what ifs" and concerns that can manifest in mental health challenges, physical health issues, or inability to navigate daily life. You don't have to go through this alone.

Choosing to work with my firm, Garth R. Goodman, P.A., means taking a step towards easing that stress. My goal is to help you move forward confidently into the next chapter of your life.

In St. Petersburg, Florida, my law firm stands ready to protect your rights and advocate for your best resolution. I understand the heightened emotional and financial stresses involved in these proceedings and strive to provide compassionate, efficient representation.

Understanding Contested Divorce

A contested divorce occurs when spouses cannot come to an agreement on one or more critical issues such as property division, child custody, child support, or alimony. This type of divorce is much more common than uncontested divorce, where both parties can resolve all issues without court intervention.

In contested divorce cases, it's essential to have a skilled and knowledgeable attorney by your side to advocate for your best interests and protect your rights.

The Process and Timeline

Contested divorce proceedings are inherently more complex and time-consuming than uncontested divorces. Couples entering a contested divorce in Florida should expect the process to take nine months to three years.

The process begins when one spouse files a "Petition for Dissolution of Marriage," alleging reasons why the marriage should be dissolved. The petitioner must then serve these documents to their spouse, initiating the legal process.

Both parties will then enter a phase of discovery, exchanging financial records, and other pertinent information to fully understand the marriage's assets and liabilities. Mediation is typically encouraged (and sometimes required) to resolve issues without going to trial.

If mediation does not result in an agreement, the case proceeds to trial, where a judge will make decisions on all unresolved issues. This process can take anywhere from several months to several years, depending on the complexities of the case and the court's schedule.

How a Divorce Lawyer Can Assist You

  • Making sure all the important legal paperwork is done right and on time.

  • Standing up for you in court and always advocating for what's best for you.

  • Talking things through for you, aiming to get a good deal before things reach trial.
